Initiating the divorce process requires preparing and submitting an application to the court, which is then issued by the court to commence the divorce proceeding. The type of divorce requested will depend on the issues involved and any agreement between you and your spouse:

Simple, Uncontested Divorce: With a simple, uncontested divorce, one party begins the divorce proceeding and the other spouse does not oppose or contest the divorce. Simple, uncontested divorces are often completed after a Separation Agreement has been finalized and signed. When there are no outstanding issues in your separation other than the divorce itself, a simple, uncontested divorce can offer a cost-effective and streamlined resolution.

Joint Consent Divorce: When both you and your spouse agree to a divorce and are prepared to cooperate in the divorce process, a joint application for divorce (filed by you and your spouse together) may be appropriate. This collaborative approach can help streamline the divorce process and reduce costs.

Where there are other legal issues related to your separation that remain outstanding, such as parenting issues, child or spousal support, or property-related issues, the parties typically work with lawyers to draft an agreement that outlines how they will handle these issues before commencing the joint application. All or part of that agreement may be incorporated into the final divorce order.

Contested Divorce: If you and your spouse disagree about getting divorced or how to resolve the corollary (other legal) issues arising from your separation, such as parenting, support, or property issues, the divorce application would be contested and proceed through the court system. Our team of family lawyers will guide you through the intricacies of the court system while continuing to work towards a final agreement between you and your spouse, if feasible. If a resolution is not reached, a judge will have to decide the matter after a trial.
